Our Compliance and Administrative Law team is the first professional team in Fujian Province specializing in administrative law affairs. It comprises a group of professional lawyers who have long been engaged in administrative trials and administrative law research. The team has provided legal advisory services to governments and administrative agencies at provincial, municipal, county, and district levels, including public security, natural resources, forestry, market regulation, urban construction, safety regulation, foreign exchange management, securities regulation, customs, development and reform commissions, finance, data, and drug regulation, among others. The team also provided legislative services for several local regulations and government rules for the Fujian Provincial People’s Congress, Fuzhou Municipal People’s Congress, and the Fujian Provincial Government. Notably, the team participated as a third-party institution in the revision of the Fujian Province Property Management Regulations, which was rated as one of the most influential regulations in the 40 years since the establishment of the Fujian Provincial People’s Congress Standing Committee. Additionally, the team has innovatively developed administrative law compliance business, acting as agents for enterprises in administrative review and administrative litigation, assisting enterprises in resolving administrative disputes, and providing administrative supervision and compliance services. The cases represented by the team have been repeatedly selected as top ten cases for protecting the business environment in Fujian Province and typical cases of administrative litigation.

Representative Achievements:

1. One of the first law firms in Fujian Province to be commissioned to draft legislation

Topwe was commissioned to draft local regulations and administrative rules, including the Fujian Province Volunteer Service Regulations, Fuzhou Postal Regulations, Regulations on Smoking Control in Public Places in Fuzhou, Measures for the Protection and Management of the Three Lanes and Seven Alleys in Fuzhou, and Measures for the Classification Management of Household Waste in Fuzhou, pioneering a new model for Fujian Province’s legal industry providing legislative services to the government and legislative bodies.

2. Represented the Gutian County People’s Government in an administrative agreement and administrative compensation case with Gutian Cuiping Lake Aile Real Estate and Aile Investment Company, which was selected as a typical administrative litigation case by the Supreme People’s Court in 2020 and one of the top ten cases for improving the business environment in Fujian Province.

3. Represented Fujian Techno Food Ingredients Co., Ltd. in an administrative penalty case against Haicang Customs of the People’s Republic of China, which was selected as one of the top ten typical cases in Fujian courts in 2018.

4. Represented Xiangxing Group in a case where the municipal government and the city’s Natural Resources and Planning Bureau imposed an administrative penalty of confiscation on buildings valued at 2 billion yuan and re-auctioned the land. The case involved cooperating with the court to rectify irregularities in the operation of a private enterprise and to correct errors made by the administrative authorities during enforcement. This successfully resolved a predicament that had brought a private enterprise, employing tens of thousands of people, to the brink of bankruptcy due to mixed faults from both parties, achieving good social effects.

5. Represented a Xiamen hot spring resort in an administrative penalty case against the Xiamen Municipal Natural Resources and Planning Bureau, correcting long-standing misconceptions about illegal land transfers on leased land by administrative agencies.
